For the purpose of this document the terms “we”, “our” and “us” refer to HEATHER KITCHEN YOGA and any related companies. These Terms and Conditions form part of your agreement with HEATHER KITCHEN YOGA trading in Australia. By accessing our website and subscribing to the VIP Members Video Library you agree to be bound by and comply with these terms. These Terms and Conditions may be updated from time to time.

 

BECOMING A VIDEO LIBRARY MEMBER

In order to become a Video Library Member with us, you must: provide an email address and credit card details. After the 7-day free trial, membership continues with a subscription billed monthly in $AUD, you can cancel at any time. When you subscribe and continue your Video Library Membership after the 7-day free trial you agree to be charged AUD$59 monthly unless you unsubscribe or inform us you wish to be unsubscribed.

Subscriptions will automatically be renewed and your credit card will be charged on the renewal date without the need for any further notice from you. You always have an option to cancel your subscription, any time prior to the renewal date.

We reserve the right to change or remove any content from our website without the need to inform you prior.

 

CANCELLING YOUR MEMBERSHIP / SUBSCRIPTION

You can cancel your subscription at any time by going to the “MY SUBSCRIPTIONS” page in your members login on our website and then clicking on the link to unsubscribe.  OR you can contact us and request we unsubscribe you with 3 days notice before your next payment is due. You will be advised via email that your request has been completed. We do not provide refunds for cancelled monthly subscriptions. When cancelling prior to the due date for your next payment, your account will remain active and useable for the remaining period that has been paid for.

 

VIEWING THE VIDEOS

Videos can be viewed on computers, tablets and smart phones via a web browser. Heather Kitchen Yoga makes no guarantees that the videos can be viewed via smart TV’s, Roku or Apple TV.

Copyright in this web site (including text, graphics, logos, icons, sound recordings, image and video recordings and software) is owned or licensed by us.  You may not in any form or by any means:

1. adapt, reproduce, store, distribute, print, display, perform, publish or create derivative works from any part of this web site; or

PAYMENT METHODS

 

All payments made will be in Australian Dollars ($AUD). Payment for the services on this site may be made by credit card. Currently, we accept the following major credit cards: Visa® and MasterCard®.  You will be required to provide us with the security code on your credit card. You authorise us and our agents to transact payments on your behalf. Incorrect information may cause a delay in processing, or denial of your order. We reserve the right to suspend Service to you in the event you have provided inaccurate or incomplete credit card information.

 

FRAUDULENT CARDS TRANSACTIONS

 

We will not tolerate unauthorized credit card transactions.

We will fully investigate and we will prosecute all incidents of credit and debit cards fraud including but not limited to reporting such incidents to the relevant law enforcement authorities.

Furthermore, we reserve the right to permanently suspend and ban your account from this website.

CLOSING ACCOUNTS AND LIMITING ACCOUNT ACCESS

At our sole discretion, we reserve the right to close an account at any time for any reason, including but not limited to a violation of this Agreement.

Any of the following events may lead to your account being limited OR suspended:

• Reports of unauthorized or unusual credit card or bank account use associated with the account

• Receipt of potentially fraudulent funds

• Refusal to cooperate in an investigation or provide confirmation of identity when requested

• The account has been used in or to facilitate fraudulent activity.

I agree to take full responsibility for monitoring my own condition and not exceed my limits. I agree to use caution throughout my activities including the use of all props and supports. I acknowledge there are risks associated with physical activity. It is my responsibility to ascertain there is no medical reason to prevent my participation. I take full responsibility for my own health and safety. I waive any claim that I might have at any time for injury of any sort against Heather Kitchen Yoga. I, my heirs or legal representatives, forever release, waive, discharge and covenant not to sue Heather Kitchen Yoga for injury or death. I have read, accept and understand these terms.

AUSTRALIAN AGREEMENT

 

These Terms and Conditions are governed by the laws in force in the State of Queensland. In the event that the State of Queensland does not have jurisdiction to hear matters relating to this agreement, then the laws of the Commonwealth of Australia will apply. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.
